Well, if you shove it into the room, yes. If you record from outside the room (in front of the door crack), it should be ok. But we should consider to seriously discussing the thin line between legal and illegal recordings.

recording other people is illegal if they don't know about it.
(at least in germany: http://gesetze-xxl.de/gesetze/stgb/p201.htm)

i don't know if moaning is like speaking in that sense...
however, there are plenty of files on that site where people talk.
