BC football player charged in secret sex recording

A Boston College football player has been charged with secretly making an audio recording of two students having sex.

Backup defensive lineman Jaryd Rudolph was released on his own recognizance Wednesday after pleading not guilty to violating the state’s wiretap statute.

Attorney Mitchell Garabedian, who represents a female Boston College graduate student, said neither his client nor her partner — another BC player — knew of a Feb. 15 cell phone recording. He said she learned about it after Rudolph distributed it and she was mocked by other students.

Rudolph’s attorney, John Seed, said his client is innocent and there’s a question of whether the recording even exists.

Boston College said 19-year-old Rudolph is on probation and suspended from the team.

The maximum prison sentence upon conviction is 2 ½ years.

Dunno if this has been posted here. What shockes me is obviously the max prison sentence! Would it be illigal to record sound you hear from places like your own house/balcony, a corridor in a hotel or appartment block or public area like under someones bedroom window at all? Or just in America where you can be put away for ages for a smelly fart?

I think, if the song is recorded in a public place where anyone can hears that in anytime, that is not a criminal item.

But, if the recorder or the microphone is placed in the other people's room, flat, etc. , that is an illegal action.

All depend on the diferent laws in each country, but installing a recordig device inside other people house is completelly illegal in most of the countries.
Recording from outside is illegal too in some european countries.

I read the article but ist not clear how the recording was made. As far as I know it is only illegal if you intrude into the house or Apartment and make a recording. If he just made it outside their Apartment, then it should be legal.
